Article 3 Compliance Regulation (EU) No 923/2012 The Member States shall ensure compliance with the common rules and provisions set out in the Annex to this Regulation without prejudice to the flexibility provisions contained in Article 14 of the Regulation (EC) No 216/2008 and the safeguards contained in Article 13 of Regulation (EC) No 549/2004.
Article 3 Compliance Regulation (EU) 2024/404 The Member States shall ensure compliance with the common rules and provisions set out in the Annex to this Regulation without prejudice to the flexibility provisions contained in Article 14 of the Regulation (EC) No 216/2008 and the safeguards contained in Article 13 of Regulation (EC) No 549/2004. *[applicable until 30 April 2025 – Regulation (EU) 923/2012]* The Member States shall ensure compliance with the common rules and provisions set out in the Annex to this Regulation without prejudice to the flexibility provisions contained in Article 71 of Regulation (EU) 2018/1139 and the safeguards contained in Article 13 of Regulation (EC) No 549/2004. *[applicable from 1 May 2025 – Regulation (EU) 2024/404]*
## Article 3 Compliance *Regulation (EU) 2024/404* The Member States shall ensure compliance with the common rules and provisions set out in the Annex to this Regulation without prejudice to the flexibility provisions contained in Article 71 of [Regulation (EU) 2018/1139](https://www.easa.europa.eu/en/regulations/basic-regulation) and the safeguards contained in Article 13 of [Regulation (EC) No 549/2004](https://eur-lex.europa.eu/eli/reg/2004/549/oj/eng).
