21.A.708 Flight conditions Regulation (EU) 2015/1039 Flight conditions include: (a) the configuration(s) for which the permit to fly is requested; (b) any condition or restriction necessary for safe operation of the aircraft, including: 1. the conditions or restrictions put on itineraries or airspace, or both, required for the flight(s); 2. any conditions or restrictions put on the flight crew to fly the aircraft, in addition to those defined in [Appendix XII](#_DxCrossRefBm1649096969) to this [Annex I](#_DxCrossRefBm1649096856) (Part 21); 3. the restrictions regarding carriage of persons other than flight crew; 4. the operating limitations, specific procedures or technical conditions to be met; 5. the specific flight test programme (if applicable); 6. the specific continuing airworthiness arrangements including maintenance instructions and regime under which they will be performed; (c) the substantiation that the aircraft is capable of safe flight under the conditions or restrictions of point (b); (d) the method used for the control of the aircraft configuration, in order to remain within the established conditions.
#### 21.A.708 Flight conditions *Regulation (EU) 2024/1108* Flight conditions include: (a) the configuration(s) for which the permit to fly is requested, including, for unmanned aircraft, the configuration of the CMU that is used to control the aircraft; (b) any condition or restriction necessary for the safe operation of the aircraft, including: 1. the conditions or restrictions put on itineraries or airspace, or both, required for the flight(s); 2. any conditions or restrictions put on the flight crew to fly the aircraft, in addition to those defined in [Appendix XII](#_DxCrossRefBm485230460) to this [Annex I](#_DxCrossRefBm485230346) (Part 21); 3. the restrictions regarding carriage of persons other than flight crew; 4. the operating limitations, specific procedures or technical conditions to be met; 5. the specific flight test programme (if applicable); 6. the specific continuing airworthiness arrangements including maintenance instructions and regime under which they will be performed; 7. for unmanned aircraft, specific arrangements and instructions for the operation and the continuing airworthiness of the UAS or of the CMU; (c) the substantiation that the aircraft is capable of safe flight under the conditions or restrictions of point (b); (d) the method used for the control of the aircraft configuration, including, for unmanned aircraft, the configuration of the CMU that is used to control the aircraft, in order to remain within the established conditions.
