21.A.130 Statement of conformity Regulation (EU) 2021/1088 (a) Each manufacturer of a product, part or appliance manufactured under this Subpart shall raise a statement of conformity, an [EASA Form 52](#_DxCrossRefBm1649096923) (see [Appendix VIII](#_DxCrossRefBm1649096923)), for complete aircraft, or [EASA Form 1](#_DxCrossRefBm1649096870) (see [Appendix I](#_DxCrossRefBm1649097171)), for other products, parts or appliances. This statement shall be signed by an authorised person who holds a responsible position in the manufacturing organisation. (b) A statement of conformity shall include all of the below: 1. for each product, part or appliance, a statement that the product, part or appliance conforms to the approved design data and is in condition for safe operation; 2. for each aircraft, a statement that the aircraft has been ground- and flight-checked in accordance with point [21.A.127](#_DxCrossRefBm1649097129)(a); 3. for each engine, or variable pitch propeller, a statement that the engine or variable pitch propeller has been subjected by the manufacturer to a final functional test in accordance with point [21.A.128](#_DxCrossRefBm1649097128); 4. additionally, in the case of environmental protection requirements: (i) a statement that the completed engine is in compliance with the applicable engine exhaust emissions requirements on the date of manufacture of the engine, and (ii) a statement that the completed aeroplane is in compliance with the applicable CO2 emissions requirements on the date its first certificate of airworthiness is issued. (c) Each manufacturer of such a product, part or appliance shall: 1. upon the initial transfer by it of the ownership of such a product, part or appliance; or 2. upon application for the original issue of an aircraft certificate of airworthiness; or 3. upon application for the original issue of an airworthiness release document for an engine, a propeller, a part or appliance, present a current statement of conformity, for validation by the competent authority. (d) The competent authority shall validate by counter-signature the statement of conformity if it finds after inspection that the product, part or appliance conforms to the applicable design data and is in condition for safe operation.
#### 21.A.130 Statement of conformity *Regulation (EU) 2024/1108* (a) Each manufacturer of a product, part, appliance, CMU or CMU component manufactured under this Subpart shall present a statement of conformity, an EASA Form 52 (see [Appendix VIII](https://dxweb.easa.europa.eu/dx4/topics/appendix-viii---easa-form-52---aircraft-statement-of-conformitye377e2a0-3dba-4dbf-a952-04c70d8fb51e.docx75fce6a4a6b5.docx)), for complete aircraft, or an EASA Form 1 (see [Appendix I](#_DxCrossRefBm485230360)), for other products, parts or appliances, CMUs or CMU components. This statement shall be signed by an authorised person who holds a responsible position in the manufacturing organisation. (b) A statement of conformity shall include all of the following: 1. for each product, part, appliance, CMU or CMU component, a statement that the product, part, appliance, CMU or CMU component conforms to the approved design data and is in a condition for safe operation; 2. for each aircraft, a statement that the aircraft has been ground- and flight-checked in accordance with point [21.A.127](#_DxCrossRefBm485230620)(a); 3. for each engine, variable pitch propeller or CMU, a statement that the engine, variable pitch propeller or CMU has been subjected by the manufacturer to a final functional test in accordance with point [21.A.128](#_DxCrossRefBm485230619); 4. additionally, in the case of environmental protection requirements: (i) a statement that the completed engine is in compliance with the applicable engine exhaust emissions requirements on the date of manufacture of the engine; and (ii) a statement that the completed aeroplane is in compliance with the applicable CO2emissions requirements on the date its first certificate of airworthiness is issued. (c) Each manufacturer of a product, part, appliance, CMU or CMU component referred to in point (a) shall present a current statement of conformity for validation by the competent authority in any of the following situations: 1. upon the initial transfer by it of the ownership of such a product, part, appliance, CMU or CMU component; 2. upon application for the original issue of an aircraft certificate of airworthiness; 3. upon application for the original issue of an airworthiness release document for an engine, a propeller, a part, an appliance, a CMU and a CMU component. (d) The competent authority shall validate by countersignature the statement of conformity if it finds after inspection that the product, part, appliance, CMU or CMU component conforms to the applicable design data and is in a condition for safe operation.
