AMC1 ACNS.D.EHS.001 Applicability ED Decision 2022/008/R Background information on Mode S EHS systems is provided in [Appendix C](#_DxCrossRefBm573002735) – Background information on Mode S EHS. Provided that the differences listed in [Appendix E](#_DxCrossRefBm573002734) – Differences between CS ACNS.D.EHS and EASA AMC 20-13 have also been addressed, then previous declarations of compliance with EASA AMC 20‑13 (Certification of Mode S Transponder Systems for Enhanced Surveillance), supplemented with the additional assessments, are also acceptable means of compliance. Note: In accordance with [*Regulation (EU) No 1207/2011*](https://eur-lex.europa.eu/legal-content/EN/TXT/?uri=CELEX%3A32011R1207&qid=1649057162455), fixed-wing aircraft having a maximum take‑off mass greater than 5 700 kg or a maximum cruising true airspeed greater than 128.6 m/s (250 knots) and operating flights as general air traffic in accordance with instrument flight rules in the airspace within the ICAO EUR and AFI regions where EU Member States are responsible for the provision of air traffic services (ATS) are to be compliant with CS-ACNS, Subpart D, Section 3.
